Case Facts for Perry v Coolangatta Investments Pty Ltd (1982):

An agreement between Perri to buy a property from Coolangatta Investments Pty Ltd was made in April 1978, which included a condition that Perri must first sell one of his properties in Lilli Pilli.

However, Perri was unable to carry out the said condition which caused Coolangatta to file a breach against him.

Case Issue:

 The issue of the case was whether or not Perri did breach his contract with Coolongatta. 

Case Decision:

The ruling of the court was that, indeed, Perri did breach the contract in the case of Coolongatta. Perri v Coolangatta Investments Pty Ltd (1982). The performance of the contract was the only aspect that was not fully carried out which means that the contract had already existed and that there is the intention for the parties to fully carry out the contract. This is the case even though Perri was unable to carry out the said condition.
